Common judicial sense...

How long do you suppose it will be before US District Judge Phyllis Hamilton is decried as an "activist judge" by the Bush administration?

It's probably happened already. But why is "activist judge" a bad thing? Sounds like a judge that's earning their pay.

That's not the job of a judge.

Anyway, I suppose this means that murder is a consitutional right as well. For, that is exactly what partial-birth abortion is. You can make all of the arguments you want for other forms of abortion. However, no one in their right mind can defend this.

I was arguing about the "activist judge" phrase, not whatever was decided.

I've never though abortion was a good thing, but I do think it can be the lesser evil. Certainly compared to the old time methods for getting rid of unwanted kids, like killing them right after they're born, or killing the mother before she can give birth.

It's not your body, it's not your decision. You don't get points for trying to scare people with "murder" and whatnot. An unwanted child is simply THAT; an unwanted child. And people fully cognizant of the import and significance of bringing another life into this world DO get scared, and angry when they do not have autnomy over their bodies. Growing someone for nine months then leaving them to the winds of the child welfare system is one of the worst things you can do, if you're not someone with firsthand experience of said system. I am. You don't legalise it, people will, and I stress, *WILL*, go undergroud and get it done, and die from botched abortions. Worse yet, they'll try and do it themselves. K?

And yeah. Bush is trying to paint "activist" with a tainted brush. There's nothing wrong with being an activist. That's how my descendants got the right to vote...(shrug)
